Are You Looking to Grow or Cultivate in New York?

On February 22, 2022, Governor Kathy Hochul signed into law S.8084-A/A.9283-A, the Adult-Use Conditional Cultivator license, authorizing previously licensed hemp farmers in the state of New York to apply for a conditional license to grow flower in New York’s legal and newly regulated recreational Adult-use Industry.

The application window for the Adult-Use Conditional Cultivator License closed in the summer of 2022, so you must have completed your application precisely to avoid delays and have been successfully processed. Those still looking to apply to be a Cannabis Cultivator may do so under the following criteria:

• Indicate the Cultivator License Tier
• Indicate Indoor or Outdoor (Mix of the two)
• Can Only Own One Cultivator License (New York)

Things To Know For Your Cultivator License Application

There are currently five tiers within the Cultivator License, each providing a limited designated area for cultivation. Below you can find the measurements for each:

• Tier 1 - Less than 5,000 sq ft
• Tier 2 - 5,000 - 12, 500 sq ft
• Tier 3 - 12,500 - 25,000 sq ft
• Tier 4 - 25, 000 - 50,000 sq ft
• Tier 5 - 50,000 - 100,000 sq ft

 Important each tier has its own fee schedule and limitations on production.

Are You Wondering How Much A Cultivator License Would Cost?

• License application fees are $1,000 - All License Types (Adult-Use and Cooperative Licenses)
• ROD & ROND Licenses are $10,000
• Social and Economic Equity qualifier applicants can receive a 50% reduction, waiver, or deferred fee on a case-by-case basis.
• The license expires two years after the issued date.
• Renewal Fees are the same as the application fee unless stated otherwise.

Adult-Use Cultivator License: Permitted Activities

• Growing/Cultivating/Propogating/Tissue Culture/Cloning
• Trimming
• Harvesting
• Drying & Curing
• Sell Bulk To Another License Holder (Processor, Microbusiness, Cooperative, ROD / ROND, or Research License Holder)
• Possess a Processor License
• Possess a Distributor License
• Cannot Hold Another Cultivator License
• Cannot Hold An Adult-Use Retail License

Please note that all cultivation activities must be performed at the licensed location. It is highly recommended that all Cultivation License holders become certified in Good Agricultural and Collection Practices (GACP Certification).
