New York Adult-Use Processor License

 On November 21, the OCM released the long-awaited proposed regulations for adult use licenses in New York. The regulations are released following the OCM awarding the first 36 Conditional Adult Use Retail Dispensary (CAURD) licenses to qualified social equity applicants.

Holders of Adult-Use New York Cultivator Licenses may also hold a Processor and a Distribution License.

Before you start, it's imperative to identify what activities you would like to conduct and what products you will be making at your site. The Adult-use Processor License can be combined with Cultivator and Distributor Licenses. They may not be granted any retail or consumption lounge license. New York has implemented a two-tier licensing system that separates the production side from the retail B2C side of the industry (with the exception of the micro licenses in the State of New York, who must be vertically integrated). 

License Fee

License application fees are $1,000 for all types of Adult-Use and Cooperative Licenses.

License application fees for ROD and ROND licenses are $10,000.

Things To Know For Your Retail Operator License Application

To apply for a license, you complete the application process, which includes submitting the following documents:

• Must be at least 21+ years of age
• You must not have any disqualifying criminal convictions
• Must be a resident of New York
• Business Plan is required
• You are the leaseholder or owner of the property-zoned location
• Bank Statement
• Driver’s License or Supplementary Identification Form
•  Facilities or sites must be certified for Good Manufacturing Practices (the level depending on what products they intend to produce) 

If... Then...

•  If the applicant qualifies as a social and economic equity applicant, then they will qualify for a 50% reduction, waiver or deferred fee.

What Happens After I Submit My Adult-Use Processor License To The OCM?

After the submission of your Adult-Use Processor License, the OCM will review it and may request additional documents or information. You will be issued a license from the OCM to operate in New York upon approval.

Approved Adult-Use Processor Activities

• Purchase Flower
• Process Flower extracts (i.e., Produce oil using CO2 or other 'solventless' methods like ice water extraction, ethanol, and petroleum-based products such as butane/propane to produce oils, waxes, butter, shatter, distilled oils, diamonds, etc..
• Physical Extraction (Resin or Resin Based Products, as shown in the photo)
• Manufacturing Of Flower Based Products
• Packaging
• Sell To Licensed Distributors (After packaging)
• Purchase From a Cultivator License Holder Or Apply For a Cultivator License
• May Not Apply For Or Hold a Retail License Or Consumption Lounge License

New York Control Board has clarified that third-party extraction services may be offered to microbusinesses as they never take possession of these products, per the proposed regulations.
